Terms and conditions

This English version is a translation provided for your convenience. The German version is legally binding. Draft – to be legally reviewed before publication.

1. Scope and provider

These terms apply to all contracts for digital content concluded via this website (Beetplan). The provider and contractual partner is Lukas-Domenik Sonnenfeld, Anschrift siehe Impressum, Germany, email: sunfieldshops@gmail.com (“we”). The offer is aimed at consumers and businesses; deviating terms only apply if we expressly agree to them.

2. Subject matter

We sell digital content (files for download) that is not supplied on a physical data carrier. Content, format, scope, system requirements and right of use are set out in the respective product description, including the language of the product.

3. Conclusion of contract

The presentation of the products is not yet a binding offer. On the order summary you check the product, price and delivery method and enter your country and email address. By clicking “Order with obligation to pay” and completing payment via one of the two payment buttons (PayPal or Stripe) you make a binding offer to purchase. We accept the offer by sending you an order confirmation with the download link by email, at the latest within two working days after receipt of payment. If we do not accept the offer, we refund the payment without delay.

4. Prices and payment

All prices are final prices in euros. VAT exempt under § 19 of the German VAT Act (small business regulation) – no VAT is charged. There are no shipping costs. Payment is made in advance, either via PayPal or via the payment service Stripe (Stripe Payments Europe, Ltd., Dublin) using the payment methods offered there, e.g. card, Apple Pay, Google Pay, Klarna or SEPA Direct Debit. With PayPal, depending on what PayPal offers, other payment methods (e.g. direct debit or credit card) are available; PayPal’s terms also apply and any currency conversion is carried out by PayPal. If you pay via Stripe, you enter your payment details only on Stripe’s payment page; the purchase price is due immediately upon ordering.

5. Delivery and countries

Delivery is made exclusively as a download link by email, usually within 24 hours on working days and at the latest two working days after receipt of payment. The link is valid for at least 14 days; on request we will send it again. Please save the files after downloading. We supply customers in the EU, Norway, Iceland, Liechtenstein, Switzerland, the USA and Canada. We do not supply consumers in the United Kingdom; business customers from the United Kingdom are welcome.

6. Rights of use

You receive a simple, non-transferable right to use the content for an unlimited period within the scope of the licence on the respective product page and in the enclosed file LIZENZ.txt. Passing on, reselling, making publicly available and editing for resale are not permitted. Copyright notices must not be removed.

7. Right of withdrawal

Consumers have a right of withdrawal in accordance with the information on the right of withdrawal. The right of withdrawal expires early if you have expressly agreed that we begin performance before the withdrawal period expires, you have confirmed your knowledge that you lose the right, and we have provided you with a confirmation of the contract on a durable medium (email).

8. Warranty and updates

The statutory provisions on defects in digital products apply (§§ 327 et seq. of the German Civil Code, BGB). We provide updates that are necessary to keep the content in conformity with the contract and inform you of them by email. Functional extensions beyond this are not owed.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. In the case of slight negligence we are only liable for breach of essential contractual obligations, limited to the typical, foreseeable damage. The contents are planning aids and guide values; they do not replace professional advice in individual cases.

10. Contract text and language

The contract language is German; this English version is a translation for information. We store the order data; you can view, print or save these terms on this page at any time. The order confirmation by email contains the essential contract data.

11. Dispute resolution

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

12. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection of mandatory provisions of the law of the country of their habitual residence. Should individual provisions be invalid, the remainder of the contract remains valid.
